PORT MARLBOROUGH PORT ACCESS CARDS – TERMS AND CONDITIONS OF ISSUE AND USE

Port Marlborough port access cards are recognised as valid proof of identity by Port Marlborough NZ Ltd for the purposes of the Maritime Security Act 2004.

Set out below are the terms and conditions on which Port Marlborough (the Port) will issue a Port Access card to you and which govern your use of your Port Access card. By submitting your application for a Port Access card you agree to be bound by these terms and conditions.

  1. Qualifying for a Port Access card.

You may apply for a Port Access card if:

  • you are employed by, or contracted to work for, an organisation that has a genuine reason for accessing the Port and you are required to carry out work at the Port as an employee of, or contractor to, that organisation; or
  • you otherwise have a genuine reason for accessing the Port.
  1. Applicant Obligations

You must review all information provided in your application before submitting it to ensure that the information is accurate and complete. Port Marlborough NZ Ltd reserves the right to decline any application that contains false, inaccurate or incomplete information.

  1. Verification

If you are employed by, or contracted to work for, an organisation that has a genuine reason for accessing the Port, the security or port services team may at any time contact the organisation named in your application form (Nominated Organisation) in order to verify your identity and confirm your status as an employee or contractor of that organisation.

If you have another reason for accessing Port Marlborough, the security or port services team may at any time carry out such checks as are reasonably required in order to verify your identity and your reason for accessing the Port.

Your application is conditional on Port Marlborough verifying your identity, employee / contractor status or other reason for accessing the Port (as applicable).

  1. Issuing of Card

The fee for a Port Access card is NZD $40 (including GST), payable to Port Marlborough when completing the induction.  If your organisation is arranging multiple inductions, Port Marlborough may invoice your organisation directly, and in this case will issue your organisation with a voucher code to complete your induction.

Port Marlborough aims to process your application within [7] working days of the date that the application is received your completed application form together with payment of the fee. Port Marlborough will advise you when your Port Access card is ready for collection from the Port Operations building. In order to collect the card, you will need to present the original identity document that accompanied the application.

If you fail to pick up your Port Access card within 3 months of being notified that the card is ready then you will need to submit a new application.

  1. Refunds

Refunds will not be provided after a card is issued, or if you fail to proceed with the application after payment. Including (but not limited to):

  • Port Marlborough will not provide refunds for lost, stolen or damaged cards (refer section 10 below).
  • Port Marlborough will not provide a refund if your entry to the port is found to be unreasonable and therefore rejected.
  • Port Marlborough will not provide a refund if the card is no longer required by the applicant for any reason.
  1. Using your Port Access card

You understand that the presentation of a Port Access card does not guarantee entry to Port Marlborough.

When you come on to the Port, you must comply with Port Marlborough’s rules regarding photo identification. It is an offence under the Maritime Security Act 2004 to fail to produce satisfactory proof of identity when in a port security area and when requested by an authorised person or a port facility security officer.

A Port Access card is not transferable and can only be used by the person named on the card.

  1. Expiry

Health & Safety Inductions are valid for 2 years following completion of the online induction. When your renewal date approaches, our Port Services administrator will be in touch with you in order to renew your card.

  1. Deactivation

Port Marlborough may deactivate your Port Access card if:

  • it receives notice that the Nominated Organisation ceases to have a legitimate need to access the Port and/or you are no longer required to carry out work at the Port in your capacity as an employee or contractor of the Nominated Organisation; or
  • you cease having a genuine reason for accessing the Port.
  1. Cancellation

Port Marlborough reserves the right to cancel your Port Access card if:

  • Port Marlborough suspects that your Port Access card has been stolen or misused; or
  • you change your legal name.

Following cancellation you will need to apply for a replacement card (and the card fee will need to be paid).

  1. Lost, stolen or damaged cards

You are responsible for safeguarding your Port Access card against loss, damage, and theft. Port Marlborough does not accept liability for lost, stolen or damaged cards.

If your Port Access card is lost, stolen or damaged, then you must report this immediately to Port Marlborough. Port Marlborough will then cancel the card and you will need to apply for a replacement card (and the card fee will need to be paid).

Damaged or altered cards must be returned to Port Marlborough.

If you subsequently locate your cancelled Port Access card, then you must return it to Port Marlborough.

  1. Privacy

Port Marlborough will treat the information contained in your application form as confidential and will comply with the Privacy Act 1993 in relation to the collection, use and storage of that information. You consent to Port Marlborough sharing certain information with the Nominated Organisation or other relevant person(s) for the purpose of verifying your identity together with your status as an employee or contractor or reason for accessing Port Marlborough (as applicable).

You can elect to not provide Port Marlborough with all the required information via the application form, however Port Marlborough will then be unable to process your application or provide you with a Port Access card.

Port Marlborough may in its sole discretion vary these Terms and Conditions by publishing the updated Terms and Conditions on www.portm.devsite.net.nz
